High Peaks TMS is a covered entity under HIPAA. Your protected health information (PHI) is handled in strict compliance with the HIPAA Privacy Rule. Our Notice of Privacy Practices is provided at your first clinical visit.
1. Information We Collect
We collect information you provide directly when contacting us via web form, phone, or in-person intake. This includes: name, phone, email, insurance information, and health history relevant to TMS candidacy. We automatically collect limited technical data (IP address, browser type, pages visited) for analytics and security purposes only.
2. How We Use Your Information
We use your information to respond to consultation inquiries, verify insurance benefits, schedule appointments, coordinate care with your providers, and communicate about treatment. We do not sell, rent, or share personal or health information with third parties for marketing purposes under any circumstances.
3. Cookies and Tracking
Our website uses essential cookies (required for site function) and, with your consent, analytics cookies. We do not use advertising cookies, third-party behavioral tracking pixels, or data broker sharing. You may decline non-essential cookies via our cookie consent banner without affecting your ability to use the site or contact us.
4. California Residents — CCPA / CPRA Rights
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA): Right to Know (request disclosure of personal information collected in the past 12 months); Right to Delete (request deletion of personal information, subject to legal exceptions); Right to Correct (request correction of inaccurate data); Right to Opt-Out (we do not sell personal information — no action required); Right to Non-Discrimination (we will not discriminate for exercising CCPA rights). 5. Data Retention
Clinical records are retained per Colorado law (minimum 7 years for adults). Non-clinical web inquiry data is retained for 24 months and may be requested for deletion at any time.
6. Third-Party Services
Our site uses Google Fonts (CDN) and Google Maps (contact page). Google's own privacy policy applies to those services. We do not use Facebook Pixel, Google Analytics advertising features, or any behavioral advertising tracking.
7. Children's Privacy
This site is not directed at children under 13. Adolescent patients (ages 15–17) are treated with parental or guardian written consent; their health information is protected under both HIPAA and applicable state law.
